DUI, DWI Charge / Arrest in Houston Texas

Attorney Tad Nelson and his Houston Texas criminal defense team have extensive experience defending DWI cases. Some of the charges are listed here:

•  Driving while intoxicated (DWI)
•  Driving under the influence of drugs
•  Intoxication assault
•  Intoxication manslaughter (involuntary manslaughter)

Factors such as blood alcohol level, prior offenses, whether there was a child in the car, and the speed of the car will affect the types of punishments defendants face when appearing before a judge. The penalties range from license suspension and fines to jail time and license revocation.

When arrested for the first time, driving while intoxicated (DWI), is identified as a Class B Misdemeanor. The applicable Texas Penal Code section provides that "a person commits an offense if the person is intoxicated while operating a motor vehicle in a public place."

Houston Texas DWI Attorney Tad Nelson has had successful results for Texans accused of DUI / DWI charges because of his extensive knowledge of the laws, police procedures, and the penalties. Mr. Nelson is able to achieve positive outcomes for clients as a result of his dedication and commitment to the law. As a result of ever-changing law in Texas and detection techniques, Tad Nelson attends frequent seminars, workshops, and classes on DUI defense throughout the country.

Mr. Nelson has the skills to represent his clients before a jury. Jury trials are available to those accused of DWI or DUI in Houston or Galveston Texas. In order to gain a DWI conviction, the prosecutor must convince all jurors the defendant is guilty of drinking and driving beyond a reasonable doubt. In order to prove this claim, the prosecutor must establish that the defendant was operating a motor vehicle in a public place and in a particular county while intoxicated (includes either alcohol or drugs).

The Texas legislature has specifically defined the term "intoxication" as it relates to DWI cases. There are two definitions: Impairment of mental or physical faculties by the existence of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or having an alcohol concentration of 0.08 or more.

When drivers under the influence of alcohol have a 0.08 BAC, their critical driving skills, like judging distance and speed, steering, visual tracking, concentration, braking, and staying in driving lanes, are severely impaired. In Texas, drivers with a BAC of more than 0.08 are subject to a 90-day suspension of their driver's license as long as they have not had any other drug or alcohol-related offenses in the past ten years. Drivers with prior alcohol-related offenses will receive a suspension of their driver's licenses for at least one full year.
